Email Deliverability Optimization Agreement
Date: _____________
The Contractor (me): Patrick de Waal
The Client (you): your name, your company
1. The service
I'll audit your email setup, identify what's hurting your inbox placement, and implement the technical and strategic fixes needed to help your emails stop landing in Spam.
The goal is simple:
Get your emails seen again and give your existing funnel a fair shot at recovering lost email revenue.
This is a done-for-you service. However, successful deliverability work also requires your timely cooperation. That includes providing the necessary access, continuing healthy sending behavior, and following any sending guidelines we agree on during the project.
For the purposes of this agreement, the project start date is the date this agreement is signed and the initial 50% deposit is received.
2. Deliverables
I will handle the deliverability optimization process for the areas I can directly audit, fix, or advise on. The exact work depends on what I find during the initial audit, but may include:
1. List health review
Identifying and suppressing, removing, or segmenting obviously inactive, invalid, or high-risk subscribers where needed. This helps protect your sender reputation and reduces the chance of cold or low-quality contacts dragging down your inbox placement.
2. Automation & campaign scan
Reviewing key automations and campaigns for spam triggers, formatting issues, structural problems, and deliverability risks. Where appropriate, I may suggest or implement changes to copy, layout, links, formatting, or sending structure.
3. Blacklist & reputation checks
Checking your domain, and where relevant your sending IPs, against major blacklist and reputation sources. If an issue requires action from your ESP, hosting provider, or another third party, I'll flag it and guide the next step.
4. Authentication fixes
Auditing and, where needed, helping configure your SPF, DKIM, and DMARC records so your sending domain is properly authenticated. This helps inbox providers verify that your emails are coming from a legitimate sender.
5. Unsubscribe flow optimization
Checking that your unsubscribe process is compliant, easy to use, and set up in a way that reduces unnecessary spam complaints. Where appropriate, this may include one-click unsubscribe requirements and/or a compliant exit page.
6. Inbox placement testing
Running inbox placement tests using GlockApps or an equivalent seed-based inbox testing tool. These tests help us see where your emails are landing before and after the main fixes are made.
7. Sending pattern guidance
Reviewing your current sending behavior and giving practical guidance on volume, cadence, segmentation, and engaged-list sending during the project. This helps Gmail and other inbox providers observe healthier sending behavior after the fixes are implemented.
8. Optional anti-spam prevention
Where appropriate, installing or advising on code, form changes, or opt-in protections to reduce bot signups, fake leads, and low-quality subscribers. This helps preserve list quality and protect your sender reputation over time.
3. The investment
The total investment for this service is:
$1,500 USD
This is paid in two installments:
- 50% deposit: $750 USD due upfront to begin work
- 50% balance: $750 USD due within 7 days of successful completion, as defined by the Success Metric below
4. Success metric & results guarantee
4.1Success metric
Successful completion means achieving at least 80% of Gmail seeds landing in Inbox or Promotions — not Spam — on two back-to-back GlockApps inbox placement tests.
For the purposes of this agreement: Gmail Promotions counts as successful inbox placement. Spam does not.
The two successful tests must be:
- Separate campaigns or sends
- Normal marketing campaigns, not artificially scrubbed "hello world" tests
- Sent from your account
- Sent as part of a regular send to a commercially meaningful engaged segment of your list
- Conducted after the main fixes have been implemented
- Completed within 60 days from the project start date
A commercially meaningful engaged segment may include, for example, subscribers who opened or clicked within the last 30 days, excluding internal or test addresses.
The success metric is based solely on GlockApps Gmail seed results. It is not tied to any specific revenue, ROAS, open-rate, click-rate, or sales outcome.
4.2Why the 60-day window exists
Deliverability improvement is not always instant. After fixes are made, Gmail needs time to observe better sending behavior and updated account signals.
The 60-day window gives us enough time to:
- Complete the audit
- Implement the main fixes
- Send normally to an engaged segment
- Let Gmail observe improved behavior
- Run and confirm results with two separate inbox placement tests
Senders with reasonable sending histories and no major abusive sending patterns often see clear improvement within 1–6 weeks after fixes are implemented. The 60-day window gives us room to verify the result properly.
4.3Testing method
I will use GlockApps, or an equivalent seed-based inbox testing tool, to run inbox placement tests. For this specific offer, the success metric is focused on Gmail seeds because Gmail is usually the main driver of Spam filtering concerns for this type of project.
To qualify as a successful outcome:
- Two separate sends must each show at least 80% of Gmail seeds landing in Inbox or Promotions
- The sends must be normal campaigns to an engaged segment
- Stand-alone seed-only tests do not count
- Sends primarily to internal or test inboxes do not count
- Spam placement does not count as success
Again, Gmail Promotions counts as successful inbox placement for this agreement.
4.4The guarantee
If we do not achieve the success metric within 60 days from the project start date:
- You will receive your $750 deposit back within 2 business days
- You will not owe the remaining $750 balance
- You keep all improvements made to your account, including audit findings, fixes, and recommendations
If I do not get your emails out of Spam according to the agreed success metric, you do not pay for the service.
4.5When the guarantee does not apply
This guarantee does not apply if:
- You do not provide the required access or information within 3 business days of the project start date
- You materially change your sending practices in a way that undermines the deliverability work without written agreement
- You ignore sending guidelines we agree on in writing
- You send to purchased, scraped, rented, or non-opt-in contacts from the same sending domain during the project
- You create sudden unexplained volume spikes
- You launch additional cold campaigns from the same sending domain without prior agreement
- You change ESP, domain, sending infrastructure, opt-in source, or core email setup during the project without written agreement
Deliverability depends on both technical setup and sending behavior. If the account is changed in a way that damages or disrupts the work, the guarantee no longer applies.
5. Client pre-qualification
This results-based model is only offered to accounts that meet certain criteria. By signing this agreement, you confirm that:
- Your list is primarily made up of opt-in subscribers and/or customers
- You will not send to purchased, scraped, rented, or non-opt-in contacts from this domain during the project
- You have been emailing regularly, at minimum monthly, in the recent past
- You are willing to continue sending on a regular cadence during the project
- You are willing to follow agreed sending guidelines while the work is being completed
I only accept accounts I believe have a realistic chance of improvement within this 60-day model. This may include reviewing signals from:
- Your ESP metrics
- Google Postmaster Tools v2
- Spam dashboard data
- Compliance status
- Complaint rates
- List behavior
- Sending history
If, during the initial audit, I determine that your account is a longer-term rehab project, I will let you know. Examples may include extremely poor sender behavior, chronically abused lists, heavy purchased-list usage, severe complaint issues, or a domain reputation problem that is unlikely to be fixed within this 60-day model.
If that happens, I may either:
- Propose a different scope, timeline, and pricing model without this guarantee, or
- Decline the project and refund your deposit in full if it has already been paid
6. Ownership & case study rights
You retain full ownership of your email list, automations, templates, account assets, and related materials.
I retain the right to reference the project in my portfolio and marketing. This may include using anonymized results and performance data, such as:
- "Client X went from X% inbox placement to Y% in Z days"
- "Client X moved from Spam to Inbox/Promotions after deliverability fixes"
- "Client X improved inbox placement after authentication, list health, and sending pattern changes"
No confidential information will be disclosed without your permission. Confidential information includes, but is not limited to:
- Full list data
- Private customer data
- Proprietary strategies
- Private pricing
- Login details
- Internal business information
If I want to use your name, company name, screenshots, or identifiable results, I will ask for your written permission first.
7. Terms & cooperation
By signing this agreement, you agree to provide the access and information needed to complete the work. This may include access to:
- Your Email Service Provider
- DNS or domain management, as needed for SPF, DKIM, and DMARC changes
- Google Postmaster Tools v2
- Relevant landing pages or opt-in forms
- Relevant automations, broadcasts, and campaign data
- Any other tools reasonably needed to diagnose or fix deliverability issues
You agree to provide this access within 3 business days of the project start date. You also agree not to make material changes to your email system, list sourcing, domain setup, sending practices, or campaign volume during the project without prior written agreement.
By signing this agreement, I agree to:
- Perform the agreed audit and implementation work in a professional and timely manner
- Keep you reasonably informed of progress and significant findings
- Use industry-standard tools and best practices wherever commercially reasonable
- Work toward the agreed success metric within the 60-day project window
- Protect your private information and account access responsibly
This agreement is governed by the laws of The Netherlands. Any disputes arising from this agreement will first be addressed through good-faith mediation in Amsterdam before any other legal remedies are sought.
8. Signatures
By signing below, both parties confirm they have read, understood, and agree to the terms of this Email Deliverability Optimization Agreement.
