Email Deliverability Optimization Agreement
Date: _____________
Contractor: Patrick de Waal
Client: Client Name, Client Company
01 Before we start
This agreement is here so everything is clear before I start working on your email deliverability.
The goal is simple:
I'll help get your emails out of Spam and back in front of the people who actually asked to hear from you.
I'll audit your email setup, find what's hurting inbox placement, and make the technical and strategic fixes needed to give your funnel a fair shot again.
This is a done-for-you service.
That said, deliverability is not only about technical setup. It also depends on how the account is used while the work is being done.
So I'll handle the audit, fixes, testing, and guidance. You'll need to provide access, avoid making big changes behind the scenes, and follow the sending guidelines we agree on.
Nothing complicated. Just the basics needed to give the project a fair chance to work.
The project officially starts once this agreement is signed and the first payment has been received.
02 What I'll work on
I'll look through your email setup and fix or guide the things that are most likely hurting deliverability. The exact work depends on what I find in the audit. Not every account needs every single thing below. But the work may include:
List health
I'll review the quality of your list and identify subscribers who may be hurting your sender reputation. That can include inactive, invalid, risky, or low-quality contacts.
Depending on what I find, I may recommend suppressing, removing, or segmenting those subscribers so they stop dragging down performance.
Automations and campaigns
I'll review key automations and campaigns for issues that could hurt inbox placement. This may include:
- spam-triggering copy
- risky subject lines
- formatting issues
- link issues
- structure problems
- poor unsubscribe flow
- anything that makes the emails look less trustworthy to inbox providers
If needed, I'll suggest or make changes to improve the way your emails are being received.
Blacklists and reputation
I'll check your domain, and where relevant your sending IPs, against major blacklist and reputation sources. If something needs to be handled through your ESP, hosting provider, or another third party, I'll flag it and guide the next step.
SPF, DKIM, and DMARC
I'll check your authentication setup. That includes SPF, DKIM, and DMARC. In plain English, these records help prove that your emails are really coming from you. If something is missing, broken, or set up badly, I'll help get it fixed.
Unsubscribe flow
I'll check that your unsubscribe process is clear, compliant, and easy to use. This matters because if people can't unsubscribe easily, they're more likely to hit the Spam button. And spam complaints can quietly damage your sender reputation.
Where needed, I may help with one-click unsubscribe requirements and/or a simple compliant exit page.
Inbox placement testing
I'll run inbox placement tests using GlockApps or a similar seed-based testing tool. This helps us see where your emails are landing before and after the main fixes. We're not guessing — we're looking at what actually happens when emails are sent.
Sending pattern guidance
I'll review how you're sending and give guidance on things like:
- volume
- cadence
- segmentation
- engaged-list sending
- what to avoid during the project
This helps inbox providers see healthier behavior after the fixes are made.
Optional spam prevention
If needed, I may help with or advise on changes to your opt-in forms or landing pages to reduce fake leads, bot signups, and low-quality subscribers. This is not always needed. But when fake opt-ins are part of the problem, it can make a big difference.
03 The investment
The total investment is $1,500 USD. It is split into two parts:
- $750 upfront — this starts the project.
- $750 after successful completion — due within 7 days once we hit the success metric below.
04 How we measure success
I want this to be clear before we begin. Successful completion means:
At least 80% of Gmail seeds land in Inbox or Promotions — not Spam — on two back-to-back GlockApps inbox placement tests.
For this agreement:
Promotions counts as successful inbox placement. Spam does not.
That's because the main goal of this project is to get your emails out of Spam. Primary is great when we can get it. But for the purpose of this agreement, Inbox or Promotions both count as "not Spam."
05 What counts as a valid test
The two successful tests must be:
- two separate campaigns or sends
- sent from your actual account
- normal marketing campaigns
- sent to a commercially meaningful engaged segment of your list
- sent after the main fixes have been made
- completed within 60 days from the project start date
A commercially meaningful engaged segment could be something like people who opened or clicked in the last 30 days. Internal test emails or tiny seed-only sends do not count.
The point is to test real sending behavior, not create an artificial test that looks good but does not reflect your actual email program.
The success metric is based only on GlockApps Gmail seed results. It is not based on a specific revenue number, ROAS, open rate, click rate, or sales result.
I'll work to improve inbox placement. But your revenue also depends on your offer, list, funnel, traffic, sales process, and other factors outside this deliverability project.
06 Why there is a 60-day window
Deliverability improvement is not always instant. After the main fixes are made, Gmail still needs time to observe better sending behavior and updated account signals.
The 60-day window gives us enough time to:
- run the audit
- make the main fixes
- send normally to an engaged segment
- let Gmail observe better behavior
- test and confirm the result with two separate sends
Some accounts improve faster. Some need more time. The 60-day window gives us room to do it properly.
07 The guarantee
If we do not hit the success metric within 60 days from the project start date:
- I'll refund your $750 upfront payment within 2 business days
- you will not owe the remaining $750
- you keep the improvements already made to your account
That includes audit findings, fixes, recommendations, and any changes already implemented.
In simple terms: If I do not get your emails out of Spam according to the agreed success metric, you do not pay for the service.
08 When the guarantee does not apply
The guarantee is there to make this fair. But it only works if the account is handled properly during the project.
The guarantee does not apply if:
- you do not provide the required access or information within 3 business days
- you send to purchased, scraped, rented, or non-opt-in contacts
- you make sudden unexplained volume spikes
- you launch cold campaigns from the same sending domain without agreement
- you ignore sending guidelines we agree on in writing
- you change ESP, domain, sending infrastructure, opt-in source, or core email setup without written agreement
- you make other changes that undermine the deliverability work
Deliverability depends on both setup and behavior. So if the account is changed in a way that damages or disrupts the work, the guarantee no longer applies.
09 Who this is for
This results-based model is only for accounts I believe have a realistic chance of improving within 60 days. By signing this agreement, you confirm that:
- your list is mainly made up of opt-in subscribers and/or customers
- you will not send to purchased, scraped, rented, or non-opt-in contacts during the project
- you have been emailing regularly, at least monthly, in the recent past
- you are willing to keep sending on a regular cadence during the project
- you are willing to follow the sending guidelines we agree on
Before and during the project, I may review things like:
- your ESP metrics
- Google Postmaster Tools v2
- spam dashboard data
- compliance status
- complaint rates
- list behavior
- sending history
If I find during the audit that your account is more of a long-term rehab project, I'll tell you. That might happen if there are severe complaint issues, heavy purchased-list usage, chronically abused lists, or a domain reputation problem that is unlikely to be fixed inside this 60-day model.
If that happens, I may either:
- suggest a different scope, timeline, and pricing model without this guarantee, or
- decline the project and refund your deposit in full if it has already been paid
10 What I need from you
To do the work, I'll need access to the tools and accounts involved. This may include:
- your Email Service Provider
- DNS or domain settings
- Google Postmaster Tools v2
- relevant landing pages or opt-in forms
- relevant automations, broadcasts, and campaign data
- any other tools reasonably needed to diagnose or fix the issue
You agree to provide access within 3 business days of the project start date.
You also agree not to make major changes to your email system, list sourcing, domain setup, sending practices, or campaign volume during the project unless we agree in writing first.
Again, nothing complicated. It just keeps the work clean.
11 What I'm responsible for
By signing this agreement, I agree to:
- perform the audit and implementation work in a professional and timely way
- keep you reasonably updated on progress and important findings
- use industry-standard tools and best practices wherever commercially reasonable
- work toward the agreed success metric within the 60-day project window
- handle your private information and account access responsibly
12 Ownership and case studies
You keep full ownership of your:
- email list
- automations
- templates
- account assets
- customer data
- related materials
I may reference the project in my portfolio or marketing. This may include anonymized results like:
- "Client X went from X% inbox placement to Y% in Z days"
- "Client X moved from Spam to Inbox/Promotions after deliverability fixes"
- "Client X improved inbox placement after authentication, list health, and sending pattern changes"
I will not share confidential information without your permission. Confidential information includes things like:
- full list data
- private customer data
- proprietary strategies
- private pricing
- login details
- internal business information
If I want to use your name, company name, screenshots, or identifiable results, I'll ask for written permission first.
13 Disputes
This agreement is governed by the laws of The Netherlands. If any dispute comes up, we both agree to first try to resolve it through good-faith mediation in Amsterdam before taking any other legal steps.
14 Signatures
By signing below, both parties confirm they have read, understood, and agree to the terms of this Email Deliverability Optimization Agreement.
